DAS has made a series of changes to its stand-alone commercial legal protection (CLP) product, including the removing the 51% prospects of success requirement from the employment and legal defence sections.
DAS first introduced a commercial legal protection policy in 1977 in response to increasing legislation in the workplace in the 1970s. Legislation has continued to grow over the years as has disputes with employees. There were 186,0000 employment tribunal cases in the year 2011 to 2012, and for many companies this is their single biggest concern, especially at a time when managing staff costs is critical.
The prospects of success clause was being raised as an issue with brokers and hence the company made a decision to remove it to and make further enhancements to the employment and other sections of the policy.
Other enhancements to the policy include:
•The redundancy advice requirement for policyholders to contact DAS “prior to serving notice of redundancy” has been removed in the compensation awards section.
•Cover for any formal investigation or disciplinary hearing conducted by a business association, professional or regulatory body.
•Legal defence – Motor exclusions removed (apart from parking offences).
•Legal defence – Widened to include cover for more bodies carrying out investigations that could lead to a criminal prosecution.
